About three years ago my wife and I made the rash (and wise) decision to buy a 17th century home in Southwestern France . Puy L’Eveque is a 13th century medieval town situated on a hill overlooking the Lot River. Its narrow streets all lead upward to the summit - where the Mairie (the mayor’s office) and the church occupy the high ground (Puy L’Eveque translates as “Bishops Hill”). It is beautiful in the way of most towns built to withstand the long-passed threat of siege. But Puy L’Eveque is unmistakably struggling. Its shops are anemic and situated between empty storefronts. Its farmer’s markets and vidi greniers are lean affairs and it recently canceled its yearly medieval festival. It’s population still remains below pre-World War One levels. From the tourist office brochure:

“In 1880 the community consisted of 2950 inhabitants, boasted 4 hotels, 6 bars, 9 café’s, a mounted brigade of gendarmes, a charity office, a city toll booth, a ferry-boat at Escafignoux, a flour mill and a suspension bridge! The 1999 census registered 2159 inhabitants.”

Three kilometers away lies the rather bland town of Prayssac; with ancient roots but clearly developed in the 19th century. Lying on the flat plain of the Lot valley, its nothing special to behold but its cafes, markets and festivals are bustling. It was something of a mystery to us when we moved here.

Why is picturesque Puy L’Eveque struggling while Prayssac thrives?

This is the topic of many dinner discussions among the expatriates here. Usually the blame is laid at the hands of incapable administrators. I believe the problem goes deeper. It is a question of architecture and urban planning. Puy L’Eveque’s siege architecture just isn’t built for the modern age. It’s positioning on a hillside was chosen for its unassailability. The medieval town privileges control of all traffic (human and material) with choke points at top and bottom. Until very recently there was a single, one-way street leading up to the summit; a stoplight at top and bottom alternated the flow of traffic - for five minutes traffic led upward - the next five minutes, down. The prime vantage points are held by church and state. Puy L’Eveque is lovely but it is relic of the past: privilege of place, control from the top, constricted material flows, and strict regulation of its borders.

Prayssac makes no such assumptions or attempt to control - people and goods move freely in and out of its borders. Prayssac is a social town - it welcomes outsiders. Its hierarchies form naturally through assembly at any of a number of town squares and the town dissolves naturally into the surrounding countryside. There are no fortress walls. The Mairie and Church are discreetly nestled amidst the other edifices.

In short, Puy L’Eveque was not architected for the modern world where goods and people follow an accelerated flow… where commerce privileges open exchange and more porous, natural borders between town and countryside. The very thing that made Puy L’Eveque thrive in the 14th century makes it hard to survive in the 21st; its architecture.

Many of our 20th century behemoths resemble Puy L’Eveque . They are closed fortresses with strict, forbidding hierarchies. While information flow outside has radically accelerated (everyone has a real-time broadcast tower) the modern organization is marked by glacial response times and chokeholds on who is an “authorized” spokesperson. The world is divided between those inside (employees) with very fixed roles and responsibilities and those “outside” (everyone else) who can’t be trusted.

Hendrik Hertzberg’s insightful comment on healthcare as a by-product of the system of legislation rather than Obama, Nancy Pelosi or even (or especially) Joe Lieberman, provides a lesson not just for government but for business on how architecture is destiny:

"The American government has its human aspects—it is staffed by human beings, mostly—but its atomized, at-odds-with-itself legislative structure (House and Senate, each with its arcane rules, its semi-feudal committee chairs, and its independently elected members, none of whom are accountable or fully responsible for outcomes) makes it more like an inanimate object."

We tend to blame people and let architecture off the hook. But the structures we live within shape our behavior and govern what is possible just as the physical architecture of our towns both emerge from and reinforce the way we see world.

As the social norms set by the Social Web - openness, sharing, participation, become the norms of business (this to me is the key insight behind the new term “social business”) and as the information flow outside accelerates, organizations will need rethink their structures. They will need to think about whether or not they are designed like Puy L’Eveque or Prayssac.

Architecture is destiny.

Die Gewerkschaft der Polizei Niedersachsen ist gegen Namens- oder Dienstnummernschilder für Polizisten. An sich nicht überraschend. Sehr ehrlich scheint mir dagegen die Begründung:

Die allgemeine Kennzeichnungspflicht kann erhebliche Folgen für die Polizisten haben. Sie könnten beispielsweise mit Anzeigen und daraus folgenden Ermittlungsverfahren überzogen werden. Ob die Vorwürfe zutreffen oder nicht, die betroffenen Beamten sind in solchen Fällen für eine Beförderung gesperrt und haben mit einem beschädigten Ruf zu kämpfen.

Der Polizeigewerkschaft sind also die (angeblich) beeinträchtigten Karrierechancen wichtiger als die Aufklärung möglicher Dienstpflichtverletzungen oder gar Straftaten durch Polizisten. Selbst in Fällen, in denen die Vorwürfe zutreffen.

Das kann man wohl nur zur Kenntnis nehmen. Ebenso das nachfolgende freimütige Bekenntnis des stellvertretenden Landesvorsitzenden, der Beschwerdeführer und “Gewaltbereite” in einen Topf wirft und ohnehin nur mit haltlosen Beschwerden sowie “vermeintlichen Klagen” rechnet.

Macedonian bloggers and other new media users offered their own responses to the question “How internet changed your life?”, posed in an article [MKD] on BBC's Macedonian language site.

Darko Buldioski of Komunikacii.net applied a style figure reminiscent of Slavic antithesis to rephrase the question into “If I had no internet…” and posted the following answers:

I would not have…

…been able to write on my blog, in which I invested much and got much in return :)

…known that BBC covers this topic, as I don't listen to radio news, I read it all online

…met a bunch of excellent people with whom I regularly communicate about different subjects

…ordered various trinkets that my brother transports for me when he comes from America (it's supposedly cheaper there)

…worked on what I do now, because my work is about Internet.

Linking to the relevant South Park episode - “Over Logging” - Buldioski also invited others to share their thoughts.

Dozens of Twitter users offered their opinions via the hashtag #danemaseinternet [MKD] or “If there was no Internet”…

…I would have to carry a notebook with me like [the author] Venko Andonovski to record my thoughts [- Sead93]

…by God I would have dealt with scientific research and as a result I would have found evidence to disprove the Theory of Relativity [- goranmitev]

…I would never have discovered what life on a farm is like [- lazyvlad]

…and a number of them blamed the internet for not being in shape, lack of muscle mass or excess fatty tissue.

Marjan Zabrcanec considers his blog Golemata slika (The Big Picture) and his Twitter and Facebook profiles his “loudspeakers” for exercising his right to the freedom of speech. He explained [MKD] that he opened his first e-mail account 15 years ago, and that without internet he would not have known “which topics and arguments are used by debaters from all over the world. Research would have been tremendously hard. Now, there's Debatopedia,” and would not have been able to effectively manage his NGO, or offer cheap but powerful internet marketing campaigns for the clients of his current employer.

Vasilka Dimitrovska reckoned [MKD] that without Internet she would have never learned how to blog and use new media to “detect, present and protect cultural heritage,” and influence the public opinion, including appearing on TV.

…I would have remained just one more archeologist in the sea of unknown and anemic archeologists in Macedonia without any attention from the society, and with even less respect.

Ribaro (The Fisherman) responded via a vlog post, with audio in Macedonian and English subtitles.

Viktor Arsovski wrote [MKD] that without Internet he probably would have continued to teach English, and not take part in the founding of IT.com.mk, and…

I would take our media “for granted,” and not read information from other sources.

I would have never known that some things in the society can improve.

I would not get frustrated by watching football (soccer) on [Macedonian TV] Sitel. Now by watching online streaming I know there are quality anchors who explain about the sport instead of talking nonsense. Therefore, even though it sometimes makes me nervous, at least I know that the Internet offers me a choice!

Bloggers who posted on this subject also included Kihu Potru [MKD], who emphasized the Internet's importance in sharing art and establishing connections between artists - from visuals to haiku; Kuzmanov [MKD]; Martin [MKD]; and Dzaman [MKD].

Finaly, some people responded through comments on blogs of others, like Oksimoron, who said [MKD]:

If there was no internet… I would have walked around more, I would have been a better housewife, and would not look silly laughing alone in front of the monitor :-)

Nadezhna said [MKD]:

- I now read more books, and they are much cheaper :)
- Someone listens to my voice (reads my blog).
- The Internet helped me to get a job.

PRoom noted [MKD] that without Internet:

…would not have enrolled into post-graduate studies (found over the Internet)
- I would not have stayed awake till 5 in the morning

- I would not have been able to book a hotel in Nice
- I would not have been able to surprise my loved ones who are far away with gifts

Ich mag Blogeinträge, bei denen ich mir als Autor kaum Gedanken machen muss. Schlicht, weil sie selbsterklärend sind. Ein gutes Beispiel liefert folgendes gestern über dpa verbreitetes Statement des BKA, dass “Löschen statt Sperren” nicht funktioniert:

Ein Mitarbeiter des BKA-Referats Kinderpornografie erklärte, das BKA versuche schon seit Jahren, die Seiten im Ausland löschen zu lassen. Der Erfolg sei «sehr begrenzt».

Und zwar aus einem einfachen Grund:

Die Seiten verschwänden nach drei bis fünf Tagen, um dann an anderer Stelle in leicht abgeänderter oder auch identischer Form wieder aufzutauchen.

Warum in solchen Fällen Sperren auf Zugangsebene die bessere Lösung sein sollen, verrät der Mitarbeiter des BKA leider nicht.

Und, irgendwer überrascht? Ich bin’ es nicht.

Die Meldung ist im Kontext der “fraktionsoffenen” Sitzung der Union gestern in Berlin zu sehen, auf die ich letzte Woche kurz in den Kommentaren von Markus’ Beitrag “Alice Schwarzer und zu Guttenberg für Netzzensur” hingewiesen hatte:

Kleine Randnotiz: Während die FDP-Fraktion für den 17.03. zu einer öffentlichen Anhörung “Lösungen und Wege im Kampf gegen die Kinderpornographie” einlädt, plant die CDU-/CSU-Fraktion parallel eine “fraktionsoffene” Informationsveranstaltung zum gleichen Thema. Eingeladen sind u.a. BKA-Chef Ziercke und “Innocence in Danger”.

Wünsche, an dieser Veranstaltung teilzunehmen, werden von der Fraktion mit Verweis auf den “fraktionsoffenen” Charakter abgelehnt.

Ich möchte nicht so weit gehen und behaupten, dass es angesichts solcher Spielchen mit dem Gesprächsangebot von Familienministerin Köhler wohl nicht allzu weit her sein kann.

Allerdings stellt sich für mich durchaus die rhetorische Frage, welchen Input sich die CDU-/CSU-Fraktion von Teilnehmern erhofft, die sich bereits in der Zensurursula-Debatte als denkbar schlechte Ratgeber erwiesen haben.

Nur sollten die Bemühungen um digitale Demokratie verbessert werden. Eine Möglichkeit bestünde darin, den Plattformen des digitalen Aktivismus â€“ Twitter, Facebook und so weiter â€“ ihre neuen globalen Verpflichtungen bewusstzumachen, zu denen die Notwendigkeit zählt, die ihnen von Regimegegnern anvertrauten Daten zu schützen. Andernfalls werden Cyberangriffe auf NGOs zunehmen. Wir im Westen sollten darauf vorbereitet sein, uns in solchen Fällen einzuschalten und die kritischen Stimmen zu unterstützen, indem wir ihnen unentgeltlich helfen, so schnell und sicher wie möglich wieder online zu sein.

Evgeny Morozov wird auch eine der Keynotes auf der re:publica 2010 halten. Das Thema lautet dafür: “A Twitter Revolution without revoluationaries? What we know and what we donâ€™t know about the impact of the Internet on authoritarian states.”

Revisiting the arguments for health care reform:

Why We Reform, by Paul Krugman, Commentary, NY Times: One way or another, the fate of health care reform is going to be decided in the next few days. ... So this seems like a good time to revisit the reasons we need this reform, imperfect as it is.

As it happens, Reuters published an investigative report this week that powerfully illustrates the vileness of our current system. The report concerns the insurer Fortis, now part of Assurant Health... In particular, according to the Reuters report, it targeted every single policyholder who contracted H.I.V., looking for any excuse, no matter how flimsy, for cancellation. In the case that brought all this to light, Assurant Health used an obviously misdated handwritten note by a nurse, who wrote “2001” instead of “2002,” to claim that the infection was a pre-existing condition that the client had failed to declare, and revoked his policy.

This was illegal, and the company must have known it: the South Carolina Supreme Court ... concluded that the company had been systematically concealing its actions when withdrawing coverage, not just in this case, but across the board.

But this is much more than a law enforcement issue. ... The truth ... is that behavior like Assurant Health’s is widespread for a simple reason: it pays. A House committee estimated that Assurant made $150 million in profits between 2003 and 2007 by canceling coverage of people who thought they had insurance, a sum that dwarfs the fine the court imposed...

Beyond that, this is a story that could happen only in America. In every other advanced nation, insurance coverage is available to everyone regardless of medical history. Our system is unique in its cruelty.

And one more thing: employment-based health insurance, which is already regulated in a way that mostly prevents this kind of abuse, is unraveling. ... This means that in the absence of reform, an ever-growing number of Americans will be at the mercy of the likes of Assurant Health.

So what’s the answer? Americans overwhelmingly favor guaranteeing coverage to those with pre-existing conditions — but you can’t do that without pursuing broad-based reform. To make insurance affordable, you have to keep currently healthy people in the risk pool, which means requiring that everyone or almost everyone buy coverage. You can’t do that without financial aid to lower-income Americans so that they can pay the premiums. So you end up with a tripartite policy: elimination of medical discrimination, mandated coverage, and premium subsidies.

Or to put it another way, you end up with something like the health care plan Mitt Romney introduced in Massachusetts in 2006, and the very similar plan the House either will or won’t pass in the next few days. Comprehensive reform is the only way forward.

Can we afford this? Yes, says the Congressional Budget Office, which on Thursday concluded that the proposed legislation would reduce the deficit by $138 billion in its first decade and half of 1 percent of G.D.P., amounting to around $1.2 trillion, in its second decade.

But shouldn’t we be focused on controlling costs rather than extending coverage? Actually, the proposed reform does more to control health care costs than any previous legislation...

Can you imagine a better reform? Sure. ... But an ideal plan isn’t on the table. And what is on the table, ready to go, is legislation that is fiscally responsible, takes major steps toward dealing with rising health care costs, and would make us a better, fairer, more decent nation.

All it will take to make this happen is for a handful of on-the-fence House members to do the right thing. Here’s hoping.

Der US-Bürgerrechtsorganisation Knowledge Ecology International (KEI) ist ein Vorstoß der EU zugespielt worden, wonach das Strafrecht im Rahmen des Anti-Piraterie-Abkommens ACTA deutlich verschärft werden soll. Brüssel plädiert demnach dafür, Strafvorschriften auch gegen die "Anstiftung und Beihilfe" zur Verletzung von Rechten an immateriellen Gütern "im gewerblichen Ausmaß" zu schaffen. Zumindest in Fällen von bewussten Verstößen gegen Rechte an Markenzeichen, Urheberrechten oder bei "Piraterie" verwandter Rechte sollen entsprechende Kriminalisierungen greifen.

Na endlich kommen mal ein paar Details zu ACTA raus: Die Contentmafia will über ACTA "Anstiftung zu Copyright-Verstößen" international strafbar machen. Die haben ja wohl sowas von komplett jegliche Bodenhaftung verloren, das geht ja gar nicht mehr. Anstiftung? Ernsthaft? Unfassbar. Es wird echt Zeit für die Revolution. Und als erste Amtshandlung muß als Ausgleich für den Schaden, den diese Pfeifen in den letzten Jahrzehnten angerichtet haben, erst mal für 20 Jahre Urheberrecht komplett abgeschafft werden. Ansonsten werden wir da nie wieder einen fairen Ausgleich hinkriegen. So viel Vorkasse, wie wir da schon unfreiwillig geleistet haben... Oh, übrigens, nicht nur Anstiftung, auch "Beihilfe" wollen sie unter Strafe stellen. Damit sie endlich Piratebay verfolgen können!1!!

Neonazigegner wegen Blockadeaufrufen kriminalisiert. Linke und Grüne solidarisieren sich. Am 27. und 28. März wollen die rechtspopulistische Partei Pro-NRW und die faschistische NPD in Duisburg gegen die Merkez-Moschee marschieren. Weitere antiislamische Provokationen sind für das Wochenende in Gelsenkirchen und Leverkusen angekündigt. Antifaschisten mobilisieren seit Monaten zu Protesten. Dafür werden sie vom Staatsschutz kriminalisiert. »Mit Verärgerung mußten wir zur Kenntnis nehmen, daß zwei engagierten Bürgern des Bündnisses ›Marxloh stellt sich quer!‹ ein Schreiben der Staatsanwaltschaft ins Haus geflattert ist«, kritisiert Bundestagsabgeordnete Ulla Jelpke (Die Linke) in einer Pressemitteilung am Dienstag. Wegen angeblichen »Aufrufs zu Straftaten« laufe eine Strafanzeige gegen Michael L. und Sylvia B., informierte Jelpke. Zudem werde der Webmaster der Seite www.gelsenkirchen-nazifrei.de, Rolf Jüngermann (DKP), der »öffentlichen Aufforderung zu Straftaten« beschuldigt. Auf der Seite wird dazu aufgerufen, den Versammlungsort von Pro NRW in Duisburg durch friedliche Menschenblockaden abzuriegeln.
